Previously, in a statement , Japan issued a formal apology for the practice. On Wednesday, a different South Korean judge, Min Seong-cheol, sided with Japan and threw out the lawsuit filed by a separate group of former sex slaves. Some of the surviving women have accepted payments from the fund. The lawsuit thrown out on Wednesday was filed in by 20 plaintiffs, including 11 former sex slaves. Only four of the 11 are still alive, and all of them are in their 80s or 90s. Neither the ruling in January nor the one on Wednesday is the final say on the matter. Lee also demanded that both governments ask the International Court of Justice to rule on the case.

The sex slaves issue has been a source of a painful dispute between South Korea and Japan. The Kyodo reports shows one dispatch from the consul general of Jinan to the foreign minister that said the Japanese invasion had caused a surge in prostitution in the area, with geisha from Japan, comfort women from Japan, and comfort women from Korea. Another dispatch from the consul general of Qingdao in Shandong province in China says the Imperial Army asked for one woman to accommodate every 70 soldiers, while the navy had requested more comfort women and geisha, Kyodo said. The number of sex slaves is not certain, but historians say they numbered in the tens of thousands or more, and their purpose was to prevent the spread of disease and curtail rapes among soldiers. The Japanese government says reparations are settled but it has set up funds to support the victims.
Comfort women were women and girls forced into being sex slaves by the Imperial Japanese Army in occupied countries and territories before and during World War II. Estimates vary as to how many women were involved, with most historians settling somewhere in the range 50,—,;  the exact numbers are still being researched and debated. Originally, the brothels were established to provide soldiers with voluntary prostitutes in order to reduce the incidence of wartime rape , a cause of rising anti-Japanese sentiment across occupied territories.
